    Presentation of Study Results, IDRAP Director Suggests Revision of Regent Regulation
     
    Director of IDRAP, Bahaludin, provided input to the government of North Buton District to revise the Regent's Regulation No. 26/2018 concerning Guidelines for the Management and Establishment of Village-Owned Enterprises (BUM Desa) in North Buton Regency. This suggestion was conveyed when presenting the results of IDRAP's study to the regent regulation at a workshop on improving the quality of village governance held by the Government of North Buton in the hall of the North Buton (Monday, 01/20/2020).

    "This regulation contains many weaknesses based on a study conducted by the IDRAP. Of the 37 articles contained in it apart from the closing provision articles, 15 of them contain weaknesses related to the use of language, references, and conflicts with higher legal norms," said Bahaludin when starting the slide exposure.

    "If we look at the title, it's upside down. This is management first, then formation. It should be sequential, formation first, then management. So according to IDRAP, a good title for this Perbub is Procedures for Formation and Management, not the other way around," continued Bahaludin while showing the regulatin of Minister of Village PDTT No. 4/2015 as a comparison example.

    "It's still not included in the article. We see references to this regent regulation, one of which is regulation of Minister of Home Affairs No. 113/2014 concerning Village Financial Management. Even though there is not a single article in this regulationthat regulates BUM Desa. According to IDRAP, Regulation No. 4/ 2015 is more suitable to be used as a reference because the ministerial regulation specifically regulates BUM Desa. In addition, Ministerial Regulation No. 113/2014 which was used as a reference was also no longer valid when this regent regulation was promulgated, because it had been revoked by Ministerial Regulation No. 20/2018," explained Bahaludin while shows the date of promulgation of Regent Regulation No. 26/2018 and the date of revocation of Ministerial Regulation No. 113/2014 for comparison.

    Bahaludin revealed that one of the weaknesses of Regent Regulation Butur No. 206/2018 is also clearly seen in Article 1 which generally still uses the definition in Government Regulation No. 72/2005 concerning Villages. Even though this regulation has been revoked by Government Regulation No. 43/2014 concerning implementing regulations for the Village Law.

    "If we look at Article 1, most of the contents still use the definition in Government Regulation No. 72/2005, even though this regulation was no longer valid when this regent regulation was promulgated. This Government Regulation has been repealed with Government Regulation No. 43/2014," said Bahaludin.

    The Director of IDRAP also did not forget to highlight one of the articles that was considered quite strange, namely Article 9 regarding the reasons for dismissing members of the BUMDes board.

    "If we look at Article 9 paragraph 2 letter c, it seems that it uses language that is not standard for a statutory regulation. Members of the governing body were dismissed because (one of them) was seriously ill with little chance of recovery. This phrase is like daily language in society. Usually in Our laws and regulations recognize the phrase "permanent absence," said Bahaludin while showing the phrase in Article 9.

    "There is something else that is rather strange if we look at Article 25 paragraph 4 regarding profit sharing. We do not find profit sharing for the village's original income. Even though BUM Desa capital comes from village capital participation of at least 51 percent, but there is no distribution as income to the village," Bahaludin continued while showing the article in question.

    As is well known, this workshop was organized by the Government of North Buton and was attended by all offices/agencies in North Buton. Also present was the Chairperson of the North Buton House of Representatives (DPRD), Diwan, S.Pd., the Head of North Buton Police represented by Head of Traffic Unit Iptu Samsuddin. The Regent of Buton Utara acted as the opening act as well as being the moderator of the workshop.
